  • Comply with change order procedures for scope modifications
  • Allow reasonable time for completion based on project complexity

4. Pricing and Payment

Pricing is provided based on the information available at the time of estimate. Prices are subject to change if:

  • Site conditions differ from those represented
  • Additional work is requested beyond the original scope
  • Material costs or availability change significantly

4.2 Payment Terms

  • Payment terms are specified in each service agreement
  • Late payments may incur additional fees as permitted by law
  • We reserve the right to suspend services for non-payment

5. Emergency Services

Our 24/7 emergency services are intended for urgent make-safe situations. Emergency service rates may differ from standard rates. We will make reasonable efforts to respond promptly, but response times are not guaranteed and may vary based on circumstances beyond our control.

6. Warranties and Disclaimers

6.1 Service Warranty

We warrant that services will be performed in a workmanlike manner using industry-standard practices. Specific warranties on materials and equipment are provided by manufacturers.

6.2 Disclaimer

EXCEPT AS EXPRESSLY PROVIDED, SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIM ARISING FROM OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Insurance and Licensing

We maintain appropriate insurance coverage and comply with applicable licensing requirements. Proof of insurance and licensing may be provided upon request.

9. Cancellation and Rescheduling

  • Cancellations must be made at least 24 hours before scheduled service
  • Late cancellations may incur fees
  • We reserve the right to reschedule due to weather, emergencies, or safety concerns

10. Site Access and Safety

Client agrees to:

  • Provide safe and legal access to work areas
  • Disclose known hazards (asbestos, lead, mold, etc.)
  • Ensure tenants/occupants are notified of scheduled work
  • Secure valuable items and clear work areas as needed

11. Intellectual Property

All content on our website, including text, graphics, logos, and images, is owned by or licensed to Ark Facility Solutions and protected by copyright and trademark laws.

12. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation if negotiation fails
  3. Binding arbitration as a final resort (where permitted by law)

13. Governing Law

These Terms are governed by the laws of the state where services are performed, without regard to conflict of law principles.

14. Changes to Terms
